Terms of Service

By using Wavesite ("Service"), operated by CloudSurf Software LLC ("we", "us"), you agree to these terms. If you do not agree, do not use the Service.
1. Account
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use Wavesite.
2. Your Content
You own the content you create on Wavesite. By using the Service, you grant us a limited license to host, display, and serve your content to make the Service work (e.g., publishing your website). We do not claim ownership of your content.
3. Acceptable Use
You agree not to use Wavesite to:
- Publish illegal content or content that violates others' rights
- Distribute malware, phishing, or spam
- Impersonate others or misrepresent your identity
- Host content that promotes violence, hate, or harassment
- Violate any applicable law or regulation
We reserve the right to remove content or suspend accounts that violate these terms.
4. Subscriptions & Billing
Wavesite offers a free tier and a paid Pro tier. Pro subscriptions are billed monthly via Stripe (web) or Apple In-App Purchase (iOS).
- Web subscriptions: Cancel anytime from your account settings. Your Pro features remain active until the end of the billing period.
- iOS subscriptions: Managed through the App Store. Cancel in Settings > Apple ID > Subscriptions. Payment is charged to your Apple ID account.
Prices may change with 30 days' notice. Refunds are handled per Stripe's or Apple's refund policies.
5. AI Features
Wavesite uses AI (Anthropic's Claude) to generate and modify website content. AI-generated content may not always be accurate. You are responsible for reviewing and publishing your content.
6. Intellectual Property
Wavesite, its logo, and the underlying technology are owned by CloudSurf Software LLC. The SurfDoc format and surf-parse compiler are proprietary. Your use of the Service does not grant you rights to our intellectual property.
7. Account Deletion
You may delete your account at any time from the app settings. Deletion permanently removes your account, all websites, and all associated data. This action cannot be undone.
8. Limitation of Liability
Wavesite is provided "as is" without warranties. We are not liable for data loss, downtime, or damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the past 12 months.
9. Modifications
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
10. Governing Law
These terms are governed by the laws of the State of Nevada, United States.
11. Domain Registration Services
Wavesite offers domain name registration services through our domain registrar partner. By purchasing a domain through Wavesite, you agree to the following additional terms, which supplement the rest of this agreement.
11.1 Registrar and Registration
Domain names purchased through Wavesite are registered through Tucows Inc. (operating as OpenSRS), an ICANN-accredited domain registrar. Your domain registration is subject to Tucows' Master Domain Registration Agreement and applicable ICANN policies, which are incorporated into these terms by reference.
11.2 Registrant Information
When you purchase a domain through Wavesite, you are the beneficial owner of that domain. You acknowledge and agree that:
- You must provide accurate contact information for your domain registration as required by ICANN and the domain registrar.
- You are responsible for keeping your registration contact information current and accurate.
- Failure to maintain accurate registration information may result in domain suspension or cancellation per ICANN policy.
- WHOIS privacy protection is enabled by default to protect your personal information from public WHOIS lookups.
11.3 Domain Ownership and Portability
You own any domain you purchase through Wavesite. Specifically:
- You may transfer your domain to another registrar or hosting provider at any time, subject to ICANN's 60-day post-registration/transfer lock period.
- To transfer your domain away from Wavesite, contact us at support@wave.site and we will provide you with your domain's EPP authorization code.
- We will not hold your domain hostage or unreasonably delay transfer requests.
- Domain transfers may take up to 7 days to complete per standard registrar transfer procedures.
11.4 Domain Renewal and Expiration
- Domains are registered for a one-year period.
- Auto-renewal is enabled by default. You will be charged the then-current renewal price unless you cancel auto-renewal before the renewal date.
- If a domain expires and is not renewed, it enters a redemption period after which it may become available for registration by others. We are not responsible for domains lost due to non-renewal.
- Domain registration fees are separate from Wavesite subscription fees and are non-refundable once the domain has been registered.
11.5 Acceptable Use of Domains
- You may not register domain names that infringe on the trademarks or intellectual property rights of others.
- You may not register domains primarily for the purpose of selling them to trademark holders (cybersquatting).
- You agree to be bound by the ICANN Uniform Domain-Name Dispute-Resolution Policy (UDRP).
- You are solely responsible for ensuring your domain name does not violate any third-party rights.
11.6 Disputes and UDRP
If a domain name dispute arises (including trademark claims or UDRP proceedings), you, as the domain registrant, are the respondent and are responsible for responding to and resolving such disputes. CloudSurf Software LLC is not liable for any domain name disputes, UDRP proceedings, or trademark claims related to domains you register through Wavesite.
11.7 Limitation of Liability for Domains
We are not responsible for:
- The unavailability of a domain name you wish to register
- Domain name disputes, trademark claims, or UDRP proceedings
- Actions taken by the domain registrar (Tucows/OpenSRS) or ICANN
- DNS propagation delays or temporary domain resolution failures
- Loss of a domain due to failure to renew
- Any damages resulting from domain registration, transfer, or expiration
11.8 Service Discontinuation
If Wavesite discontinues its domain registration service or ceases operations, we will provide at least 30 days' notice and assist you in transferring your domains to another registrar at no additional cost.
11.9 ICANN Registrant Rights
As a domain registrant, you have rights and responsibilities under ICANN policy. Review them at: ICANN Registrant Rights and Responsibilities.
